Personalization Terms & Conditions

1. What these terms cover

These Custom Design Terms govern your use of the Ohsnap customization tool and any product you order through it. They apply on top of the Ohsnap Terms of Service and Privacy Policy; where a conflict exists on a customization question, the terms on this page control.

"Ohsnap," "we," and "us" mean ohSnap, Inc. "You" means the person or business placing the order. "Design" means the finished artwork you assemble in the tool. "Your Content" means anything you supply toward that Design — image files, photographs, text, logos, or other material.

By uploading anything to the tool, adding a customized product to your cart, or completing a custom order, you agree to these terms. If you do not agree, do not use the tool.

2. Who may use the tool

You must be at least 18, or the age of majority where you live, to place a custom order. Customers under that age may use the tool only with the involvement of a parent or legal guardian, who takes responsibility for the order and for the content submitted.

You may be asked to create an account or provide contact details so we can reach you about a proof, a production question, or a rejected Design. Keep that information accurate — an order we cannot ask about is an order we may cancel.

If you are ordering on behalf of a company, school, team, or client, you confirm that you are authorized to bind that organization to these terms and that it has cleared the use of any brand, logo, mascot, or trademark in your Design. For volume or reseller programs, contact support@ohsnap.com; we may issue a separate written agreement that governs instead.

3. What you can create

The tool gives you three ways to build a Design, and you can combine them:

  • Upload your own images. Photographs, illustrations, or graphics you supply, subject to the file requirements shown in the tool
  • Add custom text. Names, initials, or short phrases, using the typefaces, sizes, and colors we make available.
  • Use the Ohsnap art library. Patterns, layouts, colorways, and templates we provide inside the tool.

The Ohsnap art library, our templates, the typefaces we license for the tool, and the tool itself remain our property or our licensors'. When you use library artwork, we grant you a limited, personal, non-transferable, non-exclusive license to have it printed on the Ohsnap product you order and to use the finished product for your own purposes. That license does not let you extract, redistribute, resell, or register the artwork, or apply it to anything other than the product you bought from us.

We may add, change, or retire library artwork, typefaces, product shapes, and tool features at any time. A design you saved but did not order may therefore stop being producible.

4. What you promise about your content

You are responsible for everything you submit. Each time you upload Your Content or place a custom order, you represent to us that all of the following are true:

  • You own Your Content, or you hold every permission and license needed to have it reproduced on a physical product and used as described in Section 5.
  • Your Content does not infringe or misuse anyone's copyright, trademark, trade dress, patent, trade secret, right of publicity, moral rights, or privacy rights.
  • If a person appears in or is identifiable from Your Content, you have that person's consent to use their image commercially — and a parent's or guardian's consent if they are a minor.
  • If Your Content includes a logo, team name, brand, character, or mascot you do not own, you hold a written license or written permission covering this use.
  • Your Content does not violate any law, contract, court order, or platform rule that applies to you.
  • Your Content is free of malware and does not contain hidden or embedded material that would make any of the statements above untrue.

A font, stock photo, clip-art pack, or AI image generator having been available to you is not the same as being licensed for commercial print use. Check the license that came with the material before you upload it. We do not perform rights clearance for you and we do not verify your permissions.

5. The permission you give us

You keep ownership of Your Content. We are not claiming it, and nothing here transfers your copyright to us.

You do grant us a license to use it. Specifically, you grant Ohsnap and the vendors who print, finish, and fulfill our products a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to host, store, reproduce, adapt, resize, crop, color-correct, print, display, and distribute Your Content and your Design in order to:

  • Produce and deliver your order — including proofing, reprints, quality control, and handling a support or warranty claim.
  • Operate and improve the tool — including saving your Design to your account, letting you reorder it, and troubleshooting production issues.
  • Promote Ohsnap and the customization tool — including in product photography, the storefront, email, social media, advertising, packaging, trade shows, retail displays, and press materials.

The promotional license in the third item above survives after your order ships and continues until you withdraw it. To withdraw it, write to support@ohsnap.com; we will stop new promotional uses within 30 days and remove your Design from channels we control, though we cannot recall printed materials, retail displays, or third-party reposts already in circulation.

We will not identify you by name in promotional material without asking you first. You are not entitled to payment, credit, or approval of any promotional use, and we are not obligated to make any.

We may also keep an internal record of Designs we have produced or rejected, for quality, fraud-prevention, and dispute purposes, even after an order is complete.

6. Designs we will not print

Keep it to something we can put in a box and ship. Do not submit Your Content or build a Design that:

  • infringes someone else's copyright, trademark, or other intellectual property, including brand logos, sports and entertainment marks, characters, and album or poster art you do not have rights to;
  • uses another person's name, face, voice, signature, or likeness without their permission;
  • is sexually explicit, or sexualizes anyone who is or appears to be a minor;
  • promotes or glorifies hatred, harassment, or violence against a person or group, including on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age;
  • threatens, bullies, doxxes, or targets a specific private individual;
  • promotes terrorism, mass violence, self-harm, or the abuse of people or animals;
  • advertises illegal drugs, weapons, or other unlawful goods and services, or instructs anyone in making them;
  • is designed to deceive — counterfeit branding, fake credentials, forged official seals, badges, or documents;
  • impersonates Ohsnap, a government body, or any organization you are not authorized to represent;
  • contains malware, or encodes data intended to exploit a device or payment system; or
  • is unlawful where it will be produced or delivered.

We also reserve the right to decline work that is simply unprintable or misleading as a product: files below our resolution minimum, artwork that cannot be reproduced legibly at the print size, or a Design that would obstruct a product's function — for a grip or mount, anything that interferes with the magnetic array, adhesive, hinge, or moving parts.

7. Our review and rejection rights

We may refuse any Design, at our discretion, before or after you pay. We may also stop an order mid-production if a problem surfaces late.

If we reject a Design, we will tell you at the email on the order and refund the amount you paid for the rejected item in full. Where the issue looks fixable — a low-resolution upload, a crop that clips your artwork — we may instead offer you the chance to replace the file or adjust the Design and keep the order moving.

Two things follow from this and are worth stating plainly. First, we do not pre-screen everything, and we have no duty to. Acceptance of an order, a previewed proof, or a shipped product is not our approval of your Design, not a legal opinion, and not evidence that you hold the rights you claimed in Section 4. Second, rejection is not a judgment about you. It usually means we cannot verify a right, cannot reproduce a file acceptably, or cannot take on the risk a Design carries.

We are not liable for any loss you incur because an order was rejected, paused, or cancelled under this section, beyond the refund described above.

8. Previews are approximations

The on-screen preview shows you roughly what you are ordering. It is a rendering, not a photograph of your item, and the finished product will differ from it in small ways.

Expect reasonable variation in:

  • Color. Screens are backlit and calibrated differently; inks and substrates are not. Colors will read differently on the product than on your monitor or phone, and can vary slightly between production runs.
  • Placement and scale. Printing and cutting tolerances mean your artwork may shift or scale by a small margin. Keep important details away from the edges and out of the safe-area lines shown in the tool.
  • Detail and sharpness. Fine lines, small type, gradients, and drop shadows may soften or band at print size.
  • Finish. Texture, gloss level, and how the print interacts with the product surface will not match an on-screen mock-up.

You are responsible for what you approve. Check your spelling, names, dates, and punctuation before ordering — we print your text exactly as you enter it, including errors, and a typo you submitted is not a defect. You are also responsible for the quality of the files you upload; we may print a low-resolution image as-is if you proceed past our warning.

Variation within the ranges above is normal and is not a basis for a refund or reprint.

9. Orders, production, and shipping

A custom order is an offer to buy. It becomes a contract when we send an order confirmation, and we may decline it before then — including for the reasons in Sections 6 and 7, a pricing or listing error, a suspected fraudulent payment, or an address we cannot ship to.

Prices and any customization fee are shown in the tool before checkout and may change over time; the price that applies is the one displayed when you place the order. You are responsible for applicable sales tax and, on international orders, any duties or import fees.

Customized items are made to order after your Design is accepted, so they take longer than stock items. Current production time is 1-3 business days before the order ships, on top of the transit time for the shipping method you choose. Those figures are estimates, not guarantees, and holiday periods, high volume, material shortages, and carrier delays can extend them. If you need an item by a specific date, contact support@ohsnap.com before ordering.

Custom items may ship separately from stock items in the same order, and generally cannot be combined, edited, split, or rerouted once production begins.

10. Custom items are final sale

Because each customized product is made for one customer and cannot be restocked or resold, custom orders are non-returnable, non-exchangeable, and non-refundable once production has started. This is an exception to Ohsnap's standard return policy, and it applies even if you simply change your mind about the Design.

Cancellation window. You may cancel or edit a custom order within 1 hour of placing it, or any time before it enters production, whichever comes first. Email support@ohsnap.com with your order number. Once we confirm the cancellation, we refund in full.

What we will still make right. Final sale does not cut off your rights when the fault is ours. Contact us within 30 days of delivery, with photographs, and we will replace the item or refund it if:

  • the product arrives damaged, defective, or with a manufacturing flaw;
  • the print is materially wrong — the wrong Design, the wrong product, upside down, badly misaligned, or missing text you correctly entered; or
  • the item never arrives, in accordance with standard shipping timelines.

We may ask you to return the item or to dispose of it rather than ship it back. Nothing in this section limits any warranty or remedy you have under applicable consumer protection law, which varies by state and country.

11. Reporting an infringing design

If you own a right you believe a customer Design infringes, tell us and we will act on it. Send a notice to support@ohsnap.com, including:

  • the work, mark, or right you own, and your basis for owning or representing it;
  • enough detail to identify the Design or order at issue — an order number, product link, screenshot, or listing image;
  • your name, address, phone number, and email;
  • a statement that you believe in good faith the use is not authorized by you, your agent, or the law;
  • a statement that the information in your notice is accurate and that you are authorized to act for the rights holder; and
  • your signature, physical or electronic.

On a complete notice, we may remove the Design from our systems, cancel or refund pending orders using it, stop promotional use of it, and notify the customer who submitted it. We may pass your notice to that customer, who may respond or submit a counter-notice.

Customers whose Designs are repeatedly the subject of valid notices lose access to the customization tool, and we may close their account.

We do not arbitrate ownership disputes between you and a customer, and removing a Design is not an admission of anything by Ohsnap. Filing a knowingly false notice may expose you to liability under applicable law.

12. If your design draws a claim

You agree to defend, indemnify, and hold harmless Ohsnap, its parent, affiliates, officers, employees, production and fulfillment vendors, and retail partners from any third-party claim, demand, proceeding, loss, damage, penalty, settlement, or expense — including reasonable attorneys' fees — arising out of or relating to:

  • Your Content or your Design, including any claim that it infringes or misuses someone's intellectual property, publicity, or privacy rights;
  • your breach of these terms or of the representations you made in Section 4; or
  • your use of the customization tool in violation of law.

We will notify you of a claim we intend to tender to you and will cooperate reasonably in the defense. We may take over the defense with our own counsel at our expense if we choose, and you may not settle any claim in a way that imposes an obligation or admission on Ohsnap without our written consent.

This obligation survives the completion of your order and the termination of your account.

13. Disclaimers and limits on liability

The customization tool is provided as-is and as-available. To the fullest extent the law allows, we disclaim all warranties not expressly stated here, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the tool will be uninterrupted or error-free, that saved Designs will remain available indefinitely, or that a preview will match the finished product.

We are not responsible for:

  • rights clearance for Your Content, or the consequences of your not having the permissions you represented;
  • loss or corruption of uploaded files, or of a saved Design — keep your own copy of anything you care about;
  • variation described in Section 8; or
  • delays caused by carriers, customs, suppliers, or events beyond our reasonable control.

To the fullest extent permitted by law, neither Ohsnap nor its vendors will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from the tool or a custom order. Our total liability for any claim relating to a custom order will not exceed the amount you paid for the item giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you. In that case our liability is limited to the smallest extent those laws permit.

14. Access, changes, and the legal fine print

Suspension. We may suspend or end your access to the customization tool, with or without notice, if you break these terms, submit content covered by Section 6, or use the tool in a way that creates legal or operational risk for us. Orders already in production may be cancelled and refunded.

Changes. We may update these terms. The version in effect when you place an order is the version that governs it. We will post the effective date at the top of this page and, for material changes, give notice through the store or by email.

Governing law. These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms, the customization tool, or a custom order will be resolved exclusively in the state or federal courts located in Wake County, North Carolina, and you and Ohsnap consent to the personal jurisdiction of those courts.

Severability and waiver. If a provision here is unenforceable, the rest stays in force and the provision is narrowed only as far as needed. Our not enforcing a provision on one occasion does not waive it.

Entire agreement. These terms, together with the Ohsnap Terms of Service and Privacy Policy, are the whole agreement between us about the customization tool.
